What Is a Non-QM Loan?

Outside the conventional box — but fully legitimate, fully regulated, and often the best fit.

A Non-Qualified Mortgage (Non-QM) is a loan that doesn't meet the Consumer Financial Protection Bureau's definition of a Qualified Mortgage — a set of standards around documentation, debt-to-income limits, and loan features. Non-QM loans are not subprime. They're not the pre-2008 liar loans. They are well-underwritten, documented loans that use alternative methods of verifying a borrower's ability to repay — methods that better reflect the reality of how many successful people actually earn income.

The fundamental problem Non-QM solves: tax-optimized borrowers look poor on paper. A successful business owner who runs legitimate deductions through their business may show modest net taxable income on their returns, even while real money flows through their accounts every month. Conventional lenders look at the tax returns and decline the file. Non-QM lenders look at the bank statements and approve it — because the money is real and the ability to repay is documented, just not via a W-2.

Non-QM products are issued by private portfolio lenders and non-agency investors. For a self-employed borrower who cannot get conventional approval, Non-QM is not a fallback — it's the right tool for the job.

Most Non-QM lenders require at least two years of self-employment in the same business or industry, evidenced by business licenses, accountant letters, and 1099s or business filings. Some programs allow 12 months for borrowers who transitioned from salaried employment in the same field. Consistency of income — not just current deposits — matters.
Reserves: some cash set aside after closing
Non-QM lenders generally like to see some cash reserves left over after closing, with a bit more expected on investment properties or larger loans. Terms and prepayment penalties vary by program
Terms vary across the Non-QM landscape, and some programs carry a prepayment penalty for an early payoff.
